Lifetime VPS Terms of Service

1. Definition of "Lifetime"

The term "Lifetime" as used by the Service does not mean perpetuity, the lifetime of the Customer, or an unconditional guarantee of indefinite service. "Lifetime" is expressly defined as the shorter of: (a) the operational service life of the specific physical host node, server hardware, or virtualization platform on which the Customer's VPS is provisioned; or (b) the period during which True Web Studios and/or the Owrbit platform continue to commercially operate and offer the Service.

Upon hardware end-of-life, decommissioning, or cessation of the Service or Company operations, the Lifetime term concludes. Where commercially reasonable, we will endeavor to migrate active VPS instances to replacement hardware, but we make no binding guarantee of migration, and no refund, credit, or compensation is owed if the Lifetime term concludes for any reason described in this Section.

2. One-Time Payment & Fair Use of Resources

The Service is provided in exchange for a one-time payment. This payment covers reasonable, fair use of the allocated resources for the Lifetime term. We reserve the absolute right to define, monitor, and enforce fair-use thresholds, and to throttle, suspend, or terminate any account that, in our sole discretion, imposes a disproportionate or abusive load on shared infrastructure.

3. Zero-Tolerance Acceptable Use Policy

We operate a zero-tolerance abuse policy. You may not use the Service, and may not permit any third party to use the Service, for any of the following. Violation may result in immediate suspension or permanent termination without notice, refund, or credit:

• Spam, unsolicited bulk email, or operation of open mail relays;
• Distribution of malware, ransomware, botnets, command-and-control infrastructure, or phishing content;
• Launching, hosting, or facilitating denial-of-service (DoS/DDoS) attacks, port scanning, or network intrusion;
• Hosting child sexual abuse material (CSAM) or any content exploiting minors — such activity will be reported to authorities;
• Infringement of intellectual property, piracy, or distribution of unlicensed copyrighted material;
• Cryptocurrency mining where it violates fair-use limits, fraud, carding, or financial crime;
• Any activity unlawful under the laws of the United States, the data center jurisdiction, or your jurisdiction.

You are solely and fully responsible for all activity originating from your VPS, including activity by third parties to whom you grant access and activity resulting from your failure to secure the server. The Company, True Web Studios, and Owrbit bear no liability whatsoever for Customer or third-party abuse, misuse, or unlawful conduct conducted through the Service.

4. No-Refund Policy

All one-time setup fees, professional installation fees, custom configuration fees, control-panel and software license fees, and add-on charges are strictly non-refundable once payment is received and/or work has commenced. The one-time Lifetime VPS purchase price is non-refundable after the VPS has been provisioned. Chargebacks or payment disputes initiated in bad faith will result in immediate account termination and may be pursued for recovery, including reasonable collection and legal costs.

5. Suspension & Termination

We may suspend or terminate the Service, in whole or in part, with or without notice, where we reasonably believe a violation of these Terms has occurred, where required by law or a lawful order, or where necessary to protect the integrity, security, or availability of our infrastructure or other customers. Termination for cause forfeits any remaining Lifetime entitlement without refund.

6. Data, Backups & Limitation of Liability for Data Loss

You are solely responsible for maintaining your own backups. Any backup or snapshot feature provided is offered as a convenience on a best-effort basis and is not a guaranteed or warranted backup service. To the maximum extent permitted by law, the Company, True Web Studios, and Owrbit shall not be liable for any loss, corruption, deletion, or inaccessibility of data, however caused, including hardware failure, software fault, security breach, force majeure, or our own negligence.

7. Service "As Is" & Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. The 99.9% uptime figure is a target objective and not a contractual guarantee, and does not entitle the Customer to any service credit unless expressly agreed in a separate written SLA.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company, True Web Studios, Owrbit, or their owners, officers, employees, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service. Our total aggregate liability for any and all claims shall not exceed the total one-time amount actually paid by the Customer for the specific VPS giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company, True Web Studios, Owrbit, and their affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

10. Changes to These Terms

We may modify these Terms at any time by posting an updated version at this URL. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which True Web Studios is established, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the courts located in that jurisdiction.
